(1) An enterprise shall possess a status of an enterprise legal person, come into existence for more than one year, obtain the Business License of Enterprise Legal Person after registered with the administrative departments for industry and commerce, conduct the annual inspection of industry and commerce subject to state stipulations and pass such stipulations.

(2) The registered capital shall not less than RMB 5,000,000 yuan (not less than RMB 3,000,000 in the Midwest, the same currency code as below).

(3) An enterprise has carried out tax registration, paid taxes in accordance with laws, dealt with tax inspection on a year basis pursuant to state stipulations and passed such annual inspection.

(4)The legal representative or person in charge of the aforesaid enterprise has not held the same posts of any other enterprises whose foreign trade operation permit has been revoked in recent 3 years (it means that during his terms of such posts, the foreign trade operation permit of the said enterprises has been withdrawn due to the violation of laws and regulations by such enterprises.)
