Import certification is required from related departments
for foreign investment enterprise established as encouraged
and limited B-class, foreign investment research and development
center, foreign investment enterprise oriented in advance
technology and products export to use self-owned fund
not pertaining to total investment fund to import self-use
equipment and related technology, fittings, spare parts
that can not be manufactured domestically or properties
of which fail to meet its standards while favored by tariff-free
policy for the purpose of technical renovation.

Certification
of Foreign Investment Enterprise Importing Updated
Equipment, Technology and Fittings
City or County (district) departments of foreign
economy and trade shall submit related documents
to Provincial Department of Foreign Trade and
Economic Cooperation for examination and verification
and then the latter shall issue certification
for foreign investment enterprise to import commodities
to update or repair existing equipment (complete
equipment and production line not included) in
its original approved scope of business and production.
Certification
of Registration and Verification of Technical
Renovation Project
Municipal or County (district) Commission of
Foreign Economy and Trade examine, verify and
issue certification hereof if commodities imported
for technical renovation are beyond the purposes
as defined in above-mentioned (1).
Note: Above-mentioned (1) and (2), if necessary,
shall be forwarded via Provincial Department of
Foreign Trade and Economic Cooperation to Ministry
of Foreign Economy and Trade to complete related
procedures.
Certification
of Foreign Investment Enterprise Importing Equipment
that can not be Manufactured Domestically for
Updating Enterprise Equipment or Technical Renovation
Commodities listed in List of Commodities imported
not Tariff-free for Domestically-invested Projects,
properties of whose Chinese Home-made counterparts
do fail to meet the enterprise's needs, and which
are imported with enterprise's self-owned fund
for updating and repairing equipment or technical
renovation, shall be submitted via municipal or
county (district) related departments to provincial
departments in charge to be examined and verified
and forwarded to related state administrative
departments to be issued import certification. |
| Documents required to
be submitted for enterprise’s application
to Provincial Department of Foreign Trade and Economic
Cooperation |
1. Application form for five types of foreign investment
enterprises' application for importing equipment,
technology and fittings for self use.
2. Application submitted by municipal or county
(district) department of foreign economy and trade
to Provincial Department of Foreign Trade and Economic
Cooperation;
3. Application submitted by enterprise hereof to
municipal or county (district) department of foreign
economy and trade (1 photocopy);
4. Resolution by board of directors concerning importing
self-use equipment and related technology, fittings
and spare parts through fund beyond the total sum
of enterprise's investment fund ( 1 original copy);
5. Related certifying documents concerning the sources
of self-owned fund of the application enterprise
(1 original copy offered by Accountant's Agency
and taxation department);
6. List of equipment, technology and fittings to
be imported by application enterprise for self use
(2 original copies stamped by enterprise hereof);
7. Foreign investment enterprises of encouragement
class and restricted class B shall submit the issued
Confirmatory Paper for Home-or-abroad-funded Projects
Encouraged by State for Development (1 photocopy);
8. Foreign investment Hi-tech and Export-oriented
enterprises shall submit valid status certification
letters respectively (1 photocopy);
9. Approval replies to application for establishment
of enterprise and the last application for adding
fund before this, contract, articles of association(
including supplementary contract, articles of association
and approval reply), permit certificate and business
license( 1 copy of each of them). |
| Related provisions concerning
Import of Foreign Investment Research and Development
Centers |
Pursuant to state and province-applicable provisions,
tariff-free projects whose self-use equipment (referring
to commodities not included in the List of Imported
Commodities which are Not Tariff-free for Foreign
Investment Projects) and whose related technology,
fittings and spare-parts are imported by foreign
investment-funded Research and Development centers
established in various locations (including internally-established
R&D centers in foreign investment enterprises
or separately-established research agencies for
the purpose of developing products and technology)
the total sum of investment which cannot be domestically
manufactured or the properties of which cannot meet
requirements if they are domestically manufactured
(really unclear what this means if you read it,
in relation to the earlier sentence. I am guessing
that you mean to say is in another sentence: “The
above equipment, related technology, fittings and
spare-parts fall within the total sum of investment
which cannot be domestically manufactured or the
properties of which cannot meet requirements if
they are domestically manufactured, if, within the
authority…”) within the authority of
Department of Foreign Economy and Trade, shall all
be submitted to the Provincial Department of Foreign
Trade and Economic Cooperation to be examined and
approved and, if required, to be examined and approved
by the Ministry of Foreign Economy and Trade after
being forwarded the same by the Provincial Department
of Foreign Economy and Trade. |
