| Basis for examination and approval |
Foreign investment enterprise approved and started
after January 1,1998, if its projects (including
foreign wholly-funded project, fund-added project
of foreign investment enterprise, joint or cooperative
project with total investment of less than 3 million
US dollars( 3 million US dollars included)) are
within the duty-free category for imported equipment
based upon the specifications in Circular of State
Council Concerning Adjustment of Tariff Policy for
Imported Equipment (NO.137,1997,State Council),
shall be issued by Provincial Commission of Foreign
Economy and Trade ( currently Provincial Department
of Foreign Trade and Economic Cooperation) <
Confirmatory Paper for Home-or-abroad-funded Projects
Encouraged by State for Development>, via which
and approval documents for starting enterprise from
organs in charge of foreign economy and trade and
Business License issued by industrial and commercial
administrative organs, the enterprise shall have
right to complete duty-free procedures for imported
equipment in local Customs House.
Imported equipment of foreign investment enterprise
approved and started from April 1,1996 to December
31,1997 including fund-added enterprise, shall
be free from tariff and import-related value-added
tax from January 1,1998, except commodities clearly
listed in Decree No.37 of State Council, and enterprise
hereof shall have right to submit the original
approval documents to local Customs House to complete
tariff-free procedures. |

1. Above-mentioned are ordinary procedures for applying
for establishment of foreign-funded enterprises.
2. Foreign-funded enterprise with investment of
less than 3 million US dollars (3 million US dollar
included) can submit its feasibility study report,
contract and article of association to the competent
authority of foreign economy and trade at various
levels for approval.
3. Project beyond limits of our provincial approval
authority, concerning production license permit
or quota management or under state unified management
shall be submitted to the examine and approve department
authorized by state council for approval via provincial
Planning Commission, Commission of Economy and Department
of Foreign economy and Trade.
4. Project of technical renovation shall be submitted
to county, municipal and provincial administrative
organs of economy and trade for approval and then
contract and article of association hereof shall
be submitted for approval to the competent authority
of foreign economy and trade pursuant to authority
purview accredited to them.
5. For detailed information about each step of the
procedure, please contact the related departments.
6. Project located in each Development Zone, Tariff-free
Zone shall be submitted directly to Administrative
Committee of them for approval. |
