issues the Qualification Certificate |

Enterprises that have obtained the qualification
for Management of Foreign Economic Cooperation
with the approval of Ministry of Commerce
as well as the business license issued
by the administrative departments for
industry and commerce shall apply to the
local competent authorities of foreign
trade and economic cooperation for the
Qualification Certificate. The enterprise
must obtain the Qualification Certificate
before it engages in foreign economic
cooperation business. |

economic cooperation business for the enterprise
issued by Ministry of Commerce (copy);
(II) The Business License of Enterprise
Legal Person issued by the administrative
departments for industry and commerce (copy)

Cooperation of the People's Republic of

Replacement of the Qualification Certificate
Under any of the following circumstances, an enterprise
shall obtain a new Qualification Certificate in
time:
(I) The Qualification Certificate has expired.
The period of validity for the Qualification Certificate
is five years. The enterprise shall apply for
a new certificate to the issuing authority one
month before the original one expires
(II) It is approved that the name or scope of
foreign economic cooperation business of the enterprise
makes changes.
Under the above circumstances, the enterprise
shall apply for a new certificate to the original
issuing authority. After the issuing authority
approves the application, a new certificate will
be issued and such case shall be reported to Ministry
of Commerce for reference. The serial number of
the new certificate shall be the same as the original
one and such information shall be specified in
the remarks column by the issuing authority. Local
competent authorities of foreign trade and economic
cooperation shall withdraw the original certificate.
Where any change is made to the Qualification
Certificate without involving the name or business
scope, the enterprise shall apply to the original
issuing authority for modification of the content
of the Qualification Certificate. With the approval
of the issuing authority, the enterprise shall
specify the change in the modification column
and add an official seal. A replacement of certificate
is unnecessary.
If the Qualification Certificate is lost, the
enterprise shall report to the local competent
authorities of foreign trade and economic cooperation
in time and publish a statement in national foreign
economic and trade newspapers to declare invalidity
of the lost certificate. Then it can apply for
reissue of the certificate.
When applying for a new Qualification Certificate,
the enterprise shall provide the following materials:
(I) The original Qualification Certificate
(II) Duplicated documents of the approval of foreign
economic cooperation business(or modification
of business scope) for the enterprise issued by
Ministry of Commerce or duplicated documents of
the approval of modification of the enterprise
name issued by competent authorities in charge
of foreign trade and economic cooperation at different
levels;
(III) Copy of the Business License of Enterprise
Legal Person issued by the administrative departments
for industry and commerce;
(IV) Application Form of the Qualification Certificate
(in duplicate). The enterprise shall apply for
a new (replacement of) Qualification Certificate
in time. If an enterprise fails to apply for the
Qualification Certificate over 6 months after
it obtains the qualification or apply for a replacement
of the Qualification Certificate 3 months after
the original certificate expires, it must give
reasons in writing. With the examination of local
competent authorities of foreign trade and economic
cooperation as well as the approval of Ministry
of Commerce, the enterprise can obtain a new (replaced)
certificate. |
